SC TUTORING LLC – TERMS AND CONDITIONS

Definitions
- “SC Tutoring LLC,” “we,” “our,” or “us” refers to the business entity providing tutoring services.
- “Client(s)” or “you” refers to the parent, guardian, or individual who has enrolled in or arranged tutoring services.
- “Tutor(s)” refers to the independent contractors providing tutoring services on behalf of SC Tutoring LLC.
- “Student(s)” refers to the individual receiving tutoring services.

2. Services Provided
SC Tutoring LLC offers tutoring services for K-12 subjects, SAT/ACT/PERT Prep, test preparation, homework help, and support for students with special needs or disabilities. All tutors are independent contractors and not employees of SC Tutoring LLC.
3. Payment Policy
- Rates: Sessions range depending on the subject, location, and frequency.
- Accepted Payment Methods: Cash App, Zelle, and credit card.
- Automatic Payments: By enrolling in our services, clients authorize SC Tutoring LLC to charge the provided credit card for sessions conducted, including automatic payments according to our billing policies.
- All sales of bundled tutoring sessions are final and non-refundable. This policy applies regardless of whether the bundle is paid in full or through a payment plan. If both parties have verbally agreed to a specific number of sessions, the full balance for the agreed-upon bundle remains due in the event the client chooses to discontinue tutoring before all sessions are completed.
- Payment Disputes: If a client disputes a payment that was made in accordance with our policies, they will remain liable for the cost of services provided. Clients are responsible for ensuring their payment information is accurate and up to date.
- Suspension of Services for Non-Payment: If payment is not received by the specified deadline, SC Tutoring LLC reserves the right to suspend tutoring services until the outstanding balance is settled. Continued non-payment may result in termination of services and potential legal action.
4. Cancellation & Rescheduling Policy
For 1-on-1 Sessions:
- All sessions are considered weekly and recurring unless otherwise agreed upon in writing prior to scheduling.
- Confirmation emails and/or text messages are sent as courtesy reminders the evening prior to the scheduled session. These reminders do not create the session or change the scheduled session. Clients do not need to reply if they are still attending as scheduled.
- All cancellations and rescheduling requests must be submitted through the SC Tutoring Scheduling Department:

- To preserve the session credit, cancellations or rescheduling requests must be submitted by 11:59 p.m. Eastern Time on the calendar day before the scheduled session.
- Requests received at 12:00 a.m. Eastern Time or later on the calendar day of the session are considered same-day cancellations or rescheduling requests.
- Same-day cancellations and same-day rescheduling requests are charged as one full session credit for the originally scheduled session.
- If a client requests another session after a same-day cancellation or rescheduling request, the replacement session may require an additional available session credit.
- The original timestamp of the cancellation or rescheduling request will be used to determine whether the request was submitted before or after the applicable deadline.
- If a client sends a scheduling request directly to a tutor, the tutor must direct or forward the request to the SC Tutoring Scheduling Department. When reasonably verifiable, SC Tutoring LLC may use the original timestamp of the client’s message to the tutor when determining whether the request was made before the applicable deadline.
- Tutors are not authorized to independently approve cancellations, reschedules, schedule changes, or preservation of session credits.
- Unless such cancellation is due to an emergency beyond the reasonable control of the party requesting the cancellation, such as a car accident, the applicable cancellation and rescheduling policy will apply.
- SC Tutoring LLC reserves the right to discontinue services for clients who engage in repeated late cancellations or no-shows, with or without notice, in order to maintain program consistency and fairness to tutors.
For Weekly Group Sessions (e.g., Saturday Groups):
- Group sessions are scheduled on a weekly basis and are not eligible for rescheduling.
- Cancellations must be made at least 24 hours in advance to avoid being charged.
- Cancellations made within 24 hours of the session are fully charged. No credits or refunds will be issued.
For Bootcamp Programs (e.g., SAT Bootcamp):
- Payment for Bootcamp programs is final and non-refundable.
- Attendance is the responsibility of the student. No refunds or credits will be provided for missed sessions.
- Make-up sessions are not available for Bootcamp programs unless explicitly offered in advance.
5. Scheduling, Payment, and Communication Policy
- Official Scheduling Channel: All cancellations, rescheduling requests, temporary schedule changes, permanent schedule changes, session-time questions, and other scheduling-related matters must be handled through SC Tutoring LLC’s official Scheduling Department:

- Customer Service & General Inquiries: Customer service concerns, program inquiries, enrollment interest, billing or payment inquiries, and other general matters should be directed to SC Tutoring LLC’s Customer Service & General Inquiries:

- Consent for Communication: By using SC Tutoring LLC’s services, clients consent to communication regarding scheduling, invoices, services, and other related matters through text, email, or phone from SC Tutoring LLC.
- Direct Communication With Tutors: Direct communication with tutors by phone, text, email, or other communication methods is only permitted for:
○ Coordinating meeting locations or online session links.
○ Brief introductions.
○ Clarifications about homework or session preparation.
○ Immediate issues related to joining or conducting an already scheduled tutoring session.
- All other communication, including rescheduling, cancellations, service concerns, or payment inquiries, must go through the appropriate SC Tutoring LLC communication channel.
- Tutors are not authorized to independently:
○ Schedule or reschedule sessions.
○ Approve cancellations.
○ Approve or preserve session credits.
○ Change recurring schedules.
○ Create replacement sessions.
○ Handle payments, refunds, or billing matters.
○ Make service agreements independently.
- If a client sends a scheduling request directly to a tutor, the tutor must promptly direct or forward the request to the SC Tutoring Scheduling Department.
- When reasonably verifiable, SC Tutoring LLC may use the original timestamp of the client’s message to the tutor to determine whether the request was submitted before the applicable cancellation or rescheduling deadline.
- Tutors may not make promises regarding credits, refunds, complimentary sessions, or scheduling exceptions. Any such decision must be authorized by SC Tutoring LLC.
- A scheduling change is not considered finalized until it has been processed and confirmed by SC Tutoring LLC.
- Payments and Billing: All payments, refunds, credits, invoices, billing questions, and payment arrangements must be handled directly through SC Tutoring LLC. Tutors are not authorized to independently handle these matters.
6. No Guarantee of Results
While we provide high-quality tutoring, we do not guarantee any specific academic outcomes or improvements. Each student’s progress depends on their individual effort, engagement, and external factors beyond our control.
7. Liability & Safety
- Tutor Screening: All tutors undergo a screening process and sign an independent contractor agreement.
- Property Damage: SC Tutoring LLC is not liable for any property damage. The client (parent/guardian) is fully responsible for any damages occurring during a session.
- Health & Safety: SC Tutoring LLC is not responsible for any health-related issues, including sickness or injury that may occur during tutoring sessions, whether conducted in person or online. Clients and students are responsible for maintaining their own health and safety standards.
- Property and Venue Liability: If in-person tutoring sessions take place at a third-party location (e.g., library, community center), SC Tutoring LLC is not responsible for damages, injuries, theft, or incidents at that location. Clients and students assume full responsibility for their safety and property.
8. Conduct & Behavior Policy
- SC Tutoring LLC enforces strict conduct policies for tutors and students.
- Tutors have the right to refuse service if a student is disruptive or refuses to participate.
- If complaints arise regarding a tutor, SC Tutoring LLC will investigate and will provide a replacement tutor if necessary.
- Clients are responsible for reporting any misconduct, inappropriate behavior, or abuse immediately. SC Tutoring LLC will take appropriate action but cannot assume liability for harm arising from such incidents.
- Harmful or Inappropriate Content on Tutor Screens: While tutors are expected to maintain professional conduct, SC Tutoring LLC is not liable for inappropriate or harmful content that may appear on a tutor’s screen due to third-party pop-ups or external links during an online session. Clients should report such issues immediately.
9. Confidentiality & Data Protection
- SC Tutoring LLC collects and stores personal information, including but not limited to full names, home addresses, phone numbers, and email addresses. While we take reasonable steps to safeguard this data, SC Tutoring LLC is not liable for any unauthorized access, hacking incidents, or data breaches.
- Clients acknowledge that no system is completely secure and accept the risks of providing personal information.
- SC Tutoring LLC uses third-party payment processors (Zelle, Cash App, credit card). We are not responsible for security breaches, unauthorized transactions, or processing errors related to these platforms.
10. Solicitation & Intellectual Property
- Clients agree not to solicit, hire, or engage any Tutor providing services through SC Tutoring LLC for private services outside of SC Tutoring LLC during the term of the relationship and for a period of 12 months following its conclusion.
- All tutoring materials (notes, worksheets, slides) are property of SC Tutoring LLC and may not be copied, distributed, or used outside of tutoring sessions without written consent.
- Sessions may not be recorded without mutual consent.
11. Payment Plan Agreements
- If a payment plan is agreed upon, it will be considered a binding verbal agreement between both parties, confirmed via written text (email, SMS, or similar). This agreement outlines the total number of sessions and the specific payment amounts to be made on a weekly (or otherwise agreed) basis. While no formal written contract is required, this verbal agreement may be used for legal purposes if necessary. The client agrees to complete all scheduled payments according to the plan discussed and confirmed at the time of booking.
12. Online Tutoring & Technical Issues
SC Tutoring LLC is not liable for any technical issues, internet problems, or software glitches that may disrupt online sessions. Clients are responsible for ensuring a stable internet connection.
13. Tutor Replacement & Availability
- SC Tutoring LLC does not guarantee the availability of a specific tutor. If a tutor is unavailable, we will attempt to provide a substitute, but immediate replacement is not guaranteed. If no substitute is available, clients may reschedule or request a refund for prepaid sessions.
14. Parental Responsibility & Safety
- Parental Consent for Minors: Parents or legal guardians must provide consent for tutoring services for clients under 18.
- Parents/guardians are responsible for ensuring a safe environment during sessions. SC Tutoring LLC is not liable for unsupervised interactions between tutors and minors outside of agreed-upon sessions.
15. Limitation of Liability
- SC Tutoring LLC is not responsible for indirect, incidental, or consequential damages, including but not limited to lost academic opportunities, decreased grades, emotional distress, or financial losses resulting from the use of our services.
- We are not liable for any third-party claims arising from tutoring sessions.
- Clients agree to hold SC Tutoring LLC, its employees, tutors, and affiliates harmless from any claims, damages, or liabilities.
16. Dispute Resolution
- Any disputes arising from or relating to the services provided by SC Tutoring LLC must be resolved through mediation or arbitration, rather than through litigation.
- Both parties agree to attempt to resolve any disputes amicably through mediation.
- If mediation is unsuccessful, the dispute will be submitted to binding arbitration, with the arbitrator’s decision being final and enforceable.
- This process is designed to avoid the costs and delays of a formal legal proceeding.
17. Termination of Services
SC Tutoring LLC reserves the right to terminate services at any time if a client or student:
- Violates any of the terms listed above.
- Engages in abusive behavior.
- Fails to make payments.
- Poses a risk to tutors or the company.
18. Modification of Terms
SC Tutoring LLC reserves the right to modify these Terms & Conditions at any time. Clients will be notified of significant changes, and continued use of services constitutes acceptance of the revised terms. Clients should review these terms periodically.
19. Force Majeure Clause
SC Tutoring LLC is not liable for service disruptions due to events beyond our control, including but not limited to natural disasters, pandemics, power outages, or emergencies, but it will make reasonable efforts to reschedule any service affected by such disruption within a reasonable time.
20. Agreement to Terms
By using SC Tutoring LLC’s services, you acknowledge and agree to these Terms & Conditions. This document serves as our formal agreement. For questions or concerns, please contact SC Tutoring LLC.
